Can you gett arrested for myspace?

ok well this girl i know has been taking these girls pictures and sayin they are her.She emailed the real girl from her other mysapce sayin comeone was stealing her pictures.The girl she emailed then said she nformed the police because she is a model and cant have her pictures distrbuted like that.She also said that she was goin to bring that perosn to court on a felony charge.She said her people and police were tryin to track the person down now.Is this possible.My friend is really scared and didnt mean to harm anyone.She doesnt want to go to jail or have her mom find out she did it.So is this possible to be tracked down by the police all becasue of a mysapce picture.



I mean she put them up publicly and myspace rules says anything is public,



So can she really get arrested.

She looked like a regular person myspace. they didnt have anything on the picture and they werent model

It sounds like there are many potential issues invovled here and I don't quite understand the approach taken by this model.



As !meh said, the image most probalby has copyright. It doesn't have to say copyright to have copyright. Usually, the photographer has copyright to an image he/she takes and may license the use of an images to others as they say fit. A model has no inherent right to the licensed use of an image just because it is of her.



However, people do have certain rights such as rights to privacy and to not have their character defamed. Typically in a model shoot, a model signs a model release which makes it clear the distribution of the photos are not violating these rights. The release may have some limitations on the use of the photos.



While the photographer usually is the one who initially obtains the release, it is the responsibility of the person who actually publishes the photo to make sure it is properly released. In this scenario, this is you. The fact that myspace makes it clear everything is public, doesn't obsolve you of your obligations. In fact, that it is public, only increases your responsibility.



So, my knowledge is that, in reality, the model needs to start with you. There will then be the question of weather or not these images are against the license or break the models rights. Since your friend was the photographer and gave you the images specifically to post, you are probably both licensed to use them. If the images appear to break the models rights, the question then becomes weather or not your friend, the photographer had the model sign a release that covered this.



The above is civil matter and I think the police would have little to do with it. The model has the option to sue for damages. That she just doesn't want images of herself posted on the web, probably won't get her far. She needs to show how this has negatively impacted her and how this relates to her rights and written agreements.



Where your freind may get into trouble with the police probalby has little to do with copyright or the release of images. She falsley represented herself as another real person. This may be a criminal offense. (such as identify theft) This would however, be on her shoulder and not yours.



In today's digital age, its easy to copy images, publish them and display them in a false light. The ease, however is no excuse for violating copyright law, defaming someones character or stealing their identity.



I think your friend should talk to the model in question, be polite, respectful and do what she can to satisfy the model.



These are some of the issues involved as I see them based on what you have said. I however am not a lawyer or in law enforcement, so you should not consider this legal advice.

they werent copywrittin? there was nothing saying dont steal thses? she put them on a public profile....yeah..no, thats totally illegal (sarcasm) my friend had this exact same problem with a popstar. chances are, they are both faking it.

Well, depends on the age of your friend, and most likely they would just throw this out of the court especially if she didn't have any copyright laws. They wouldn't arrest you, most likely give you a phone call telling you to take down the pictures.

No, I dont think you can since they weren't copywritten and she was just joking. The model girl is probably faking too because a real model or any celebrity wouldn't have time to accept friends and email people on a regular basis and have time to argue wwith them or w/e. No she probably won't get in trouble.

The photographer has all rights to any photo of theirs. Your friend can be charged on infringement of the copyright, but I highly doubt she will go to jail jor it. Her mother will most likely find out though.
